This Policy

Set out below is IDL Internet's (in this
Policy referred to as "we", "us" or "our") Acceptable Use Policy (the
"Policy"). You must comply
with this Policy whenever you use or access any of our Services (the
"Services"). Please read
this Policy carefully.
1.2
This Policy may be amended from
time to time by us, notification of which will be placed upon our web
site and emailed using your
login information.
1.3
You will be deemed to have accepted any
amended Policy when you use our Services after the amendments have been
made and notified on our web site.

Access to the Service
2.1
You confirm that you are over the age of
18 or that you have obtained the consent of a parent, teacher or other
responsible adult prior to using the Services.
2.2
You agree to provide the telephone line,
modem, computer, hardware, software and all other equipment required to
access the Services. You
must pay all telecommunication charges associated with accessing the
Services. Please call your
phone carrier (Telstra on 12552) to confirm call charges
to our access numbers.
2.3
Your rights and obligations under Policy
or any other agreement must not be assigned, sold, delegated, alienated,
transferred or otherwise disposed of in any way by you without our
written permission.
2.4
You are responsible for maintaining the
secrecy and confidentiality of the login information required by you to
access the Services.
2.5
You agree not to disclose to any other
person, corporation, entity or organisation any identification or login
information, whether in use or not, nor any other confidential
information relating to the Services or our
organisation.
2.6
You are liable for all fees resulting
from use of the Services accessed through your login
information.
2.7
Any misuse of the Services is your
responsibility and any such occurrences should be immediately
communicated to us. A bill
presented by us will be deemed to be correct and prima facie evidence of
all connection, access, usage and other fees contained
herein.

Content and Security
3.1
You acknowledge that we do not and cannot
in any way supervise, edit or control the content and form of any
information or data accessed through our Services and we will not be
held responsible in any way for any content or information accessed via
our Services.
3.2
We disclaim all or any liability for any
material on the Internet that you find offensive, upsetting, defamatory,
personally offensive or in any way unsuitable for people under the age
of eighteen (18).
3.3
It is your responsibility to obtain
advice as to whether the content you are accessing or dealing with is in
contravention of any State, Territory, Commonwealth or International
laws including as to whether it or you are breaching any codes,
standards or requirements enacted by any relevant authority including
the Internet Industry Codes of Practice.

What you must do
4.1
Comply with all directions pertaining to
access and use of the Services granted to you by us including, but not
limited to, this Acceptable Use Policy and your chosen Access
Plan;
4.2
Comply with all conventions and
requirements of all other services you access using our Services. This includes, but is not
limited to, newsgroups, discussion groups, chat rooms and other
networks.
4.3
Supervise at all times, person's under
the age of eighteen (18) who are using your login information to access
the Service;

What you must not do
5.1
Breach or infringe the Intellectual
Property rights of any person or entity;
5.2
Transmit material which is, or in our
reasonable opinion likely to be, obscene, offensive, harassing,
threatening, upsetting, defamatory, racially offensive, personally
offensive or in any way unsuitable for people under the age of eighteen
(18) years;
5.3
Breach any codes, standards or
requirements enacted by any relevant authority, including Internet
Industry Codes of Practice;
5.4
Use our Services for any purpose or
activity of an illegal, fraudulent or defamatory
nature;
5.5
Use our Services for any purpose or
activity which contravenes any local, State, Territory, Federal or
International Laws;
5.6
Permit anyone else (unless with your
express permission) to use your login information to access the
Services;
5.7
Attempt to guess or access any other
person's or entity's login information;
5.8
Obtain unauthorised access to any device,
system or network accessible through the Service including our
own;
5.9
Harass or impersonate our staff members
in any way;
5.10
Transmit, propagate or distribute any
viruses, worms or other harmful programs;
5.11
Engage in misleading and deceptive
business or advertising practices;
5.12
Damage, destroy or modify any data,
files, login information, equipment or resources of ours or any other
person;
5.13
Use the Service in any way which may
interfere, disrupt or impair the Service, our equipment or affect in any
way access by others to the Service;
5.14
Use the Service to send unsolicited
e-mail of any kind or post messages to inappropriate or irrelevant
forums, mailing lists, discussion groups or
newsgroups.
5.15
Use the Service to solicit subscribers to
other competing services;
5.16
When provided use a single login for IDL's SMTP Relay by more then one individual.

What we may do
6.1
Monitor your account to determine whether
Policy is be followed.
6.2
Disclose some of your information,
including information relating to your use of the Services for marketing
purposes. We will not
however disclose any information which personally identifies you, unless
you have consented to it or we are legally required to provide the
information.
6.3
Delete or reject any e-mail received by you
if:
(a)
the e-mail and any attachment exceeds the size allowed by your selected
plan or exceeds 5 mb where the size limit is not specified;
(b)
The total size of all your e-mails not
removed from our server exceeds the size allowed by your selected plan or exceeds 5 mb where the size limit is not specified; or
(c)
The e-mail is over 6 months
old
6.4
If you don't follow this Policy or have
(or in our reasonably opinion likely to have) broken any law, code,
requirement or standard we may:
(a)
Warn you of this by
email;
(b)
Suspend your access to the
Service;
(c)
Terminate your access to the Service
immediately;
(d)
Notify and provide the relevant
information to any authority.
6.5
If we take any action under clause 6.4
(b) - (d) of the Policy we may at our sole discretion delete all your
e-mail messages and login information.
6.6
Any failure or delay by us to enforce any
part of this Policy will not be construed as a waiver of our rights
under this Policy.
6.7
May impose speed limits and traffic policies to users on plans with unlimited downloads who download (in IDL's judgment) an excessive amount of data and/or represent an unusually large burden on IDL's network.
